Decisions and Dissents of Justice Ruth Bader Ginsburg Summary

Decisions and Dissents of Justice Ruth Bader Ginsburg Summary

Decisions and Dissents of Justice Ruth Bader Ginsburg by Core Brettschneider is a book based on RBG’s decisions in cases that involved women’s rights, gender equality, voting rights, and civil rights. Justice Ginsburg never shied away from dissenting majority opinion if the cases involved the rights and justice of women. Some of the cases included in the book include Burwell v. Hobby Lobby, Shelby County v. Holder, and Bush v. Gore. Part one of the book covers her decisions and dissents on cases involving gender equality and women’s rights. In part two, the book covers RBG’s decisions and dissents regarding reproductive freedom.

Part three of the book covers RBG’s decisions and dissents on cases involving voting and civil rights. The first U.S constitution denied women their rights and freedom. Women had limited rights to property, experienced immense obstacles to political participation, and were financially dependent on men. Justice Ginsburg has been vocal about women’s rights. Ginsburg helped to convince the court to ponder gender as a protected class under the 14th Amendment. According to her, women have the right to enjoy the full scope of constitutional liberty. Both men and women should have their liberty protected equally by the constitution.

Ginsburg was also a voting rights defender. In the case of Shelby County v. Holder, Ginsburg held a dissenting opinion. Actually, RBG agreed that since enacting the Voting Rights Act, voting discrimination against minority groups has reduced. However, Ginsburg disagreed with the majority opinion to do away with preclearance when it worked so well in curbing discrimination. Ginsburg compared the situation to throwing away an umbrella in a rainstorm.
